Gift cards Terms and Conditions
The following terms and conditions apply to Your purchase and use of Gift Cards on www.ledger.com (the “Gift Card Terms”).
Note the following:
the Gift Card Terms and any attachments related to it, including Global-e Sales Terms and Conditions, Ledger Privacy Policy and Cookie Policy, and, applicable guidelines, form a legal agreement between you and Global-e for your purchase of Ledger Gift Cards;
As a reminder, Ledger is collaborating with Global-e for the offering and sale of Products and associated services available on the Website. Global-e is the sales facilitation partner of Ledger that is operating this Website. Ledger has an agreement with Global-e allowing Global-e to act as the merchant of record. That means that Global-e is your Seller for your purchases on the Website.
ARTICLE 1 – ABOUT YOUR GIFT CARD
The Gift Cards are issued and managed by Global-e France SAS, a French société par actions simplifiée (simplified joint-stock company) whose registered office is located at 320 rue Saint-Honoré, 75001, Paris, France, registered in the Paris Trade and Companies Register under SIREN number 818 358 459 (“Global-e” or the “Seller”).
The Gift Card Terms apply to all digital and physical Gift Cards (each a “Gift Card” or collectively, "Gift Cards") purchased, obtained, redeemed, or used on www.ledger.com.
The Gift Cards are intended for personal use only and are not authorized for resale or commercial use.
Also note that Gift Cards can not be purchased using discount vouchers, promotional codes or other Gift Cards.
ARTICLE 2 - REDEMPTION
The Gift Cards may only be redeemed toward the purchase of the products and services provided by Global-e, Ledger and its affiliates on www.ledger.com. It can be redeemed in one or several instalments. To redeem the value associated with the Gift Card, You must enter the Gift Card code at the time of checkout. The amount of Your purchase will be deducted from the Gift Card's remaining balance. If a purchase exceeds your Gift Card balance, the remaining amount must be paid with another payment method accepted on www.ledger.com and under the conditions of the General Sales Terms and Conditions.
If the total value of your purchase is less than the balance on the Gift Card, the remaining balance will remain on the Gift Card and will be available for future purchases until expiry of the Gift Card. The balance will be updated immediately after each transaction and can be used towards subsequent purchases. There shall be no cash refunds for purchases made with a Gift Card.
ARTICLE 3 – VALUE OF THE GIFT CARD AND CURRENCY CONVERSION
The Gift Card is only available in the euro currency denomination. This means the following:
at the time of purchase of the Gift Card, the amount of the Gift Card will be converted from your local currency to the euro equivalent amount;
at the time of redemption, the amount of the Gift Card in euros will be converted into the local currency used for the redemption of the Gift Card;
In both cases, the applicable exchange rate will be the exchange rate of Global-e's bank or payment service provider in force at the time the Gift Card is being redeemed. By accepting the Gift Card Terms, you acknowledge that the value of your Gift Card may vary, if used for a purchase in a currency other than in euros.
ARTICLE 4 – BALANCE ENQUIRY
Information regarding the balance of your Gift Card is available by contacting Ledger Support. Please note that the balance provided may be an estimate. While most purchases update the balance right away, there may be occasional delays when the balance adjustment is delayed. The Gift Card may not be reloaded with additional value.
ARTICLE 5 – PERIOD OF VALIDITY
The validity of your Gift Card is five (5) years from the date of reception of the Gift Card. Upon expiry of the Gift Card, there will be no refund of any remaining balance (if any) and the Gift Card will expire.
ARTICLE 6 – RIGHT OF WITHDRAWAL/ RETURN OF PRODUCT
You may cancel the purchase of your Gift Card for any reason within fourteen (14) days from the date of reception of your Gift Card by notifying Ledger/ Global-e of your decision to withdraw from this agreement.
To exercise your right, please, follow the return procedure available on www.ledger.com, or contact Ledger Support.
If You return a Product purchased on www.ledger.com using a Gift Card, we will recredit your Gift Card for the same amount. The re-crediting of funds to the Gift Card shall not extend its validity period as indicated in Article 5 above. No cash refunds will be given for returns of Products purchased with a Gift Card.
ARTICLE 7 - RISK OF LOST, DAMAGED, OR STOLEN GIFT CARDS
The value of any lost, damaged or stolen Gift Card will not be replaced. You are responsible for safeguarding your Gift Card from unauthorized use. Title and risk of loss for Gift Cards pass to You upon the electronic transmission of the Gift Card to You.
ARTICLE 8 - FRAUD, VIOLATION OF TERMS
Ledger and Global-e reserves the right to refuse to honor, or to suspend or deactivate a Gift Card where Global-e suspects that the Gift Card was obtained fraudulently, in violation of the Gift Card Terms, or in violation of applicable laws or other applicable Global-e/ Ledger terms and conditions. Global-e is not responsible for, and assumes no liability to you for any unlawful conduct or fraud by any third party associated with any Gift Card.
ARTICLE 9 – APPLICABLE LAW – MEDIATION – COMPETENT COURTS
Please check Article 13 of Global-e Sales Terms and Conditions to check the law and jurisdiction applicable to your purchase of the Gift Card(s).
ARTICLE 10 - GENERAL
Unless otherwise specified:
In the event of any discrepancy between these Gift Cards Terms and any other documents referred to herein, these Gift Card Terms will take precedence;
All other relevant provisions of Global-e Sales Conditions apply to your purchase of the Gift Cards, and in particular Article 11 (Intellectual Property), Article 12 (Personal Data) and Article 13 (Applicable law, Mediation and Competent Courts);
In the event that a clause in these Gift Cards Terms is declared null and void or inapplicable, it must be replaced by a valid clause reflecting the objective pursued by the initial clause as closely as possible. The other clauses will not be affected and will remain in full force and effect;
The fact that Global-e does not exercise its rights under these Global-e Conditions does not in any way constitute a waiver or loss of such rights.
